Cohabitation Agreements

Dated: 29/10/2008

The Law has been developed to achieve fairness and a more or less predictable outcome to deal with the breakdown of relationships, children’s needs and untimely death – IF YOU ARE MARRIED or in a formal civil relationship.

If you are a ‘common law’ spouse or sharing a life or accommodation with a partner, friend or relative there are no such protections. The legal position is a muddle of contract, trust and intestacy law – which can have surprising outcomes, against common sense, fairness and the parties expectations.

Mike Dyer’s advice is that if you are ‘living together’ find out where you stand, give some thought to future planning and consider a Cohabitation Agreement.
