Capacity: Increasingly Litigated

With an aging population, decisions that have been taken at times of mental and physical frailty are becoming more frequently challenged in lifetime and upon death.

For this reason, contemporaneous notes that are made during our interviews with clients become very important. These notes are retained for future reference and are vital evidence if any challenge is made. Three of our solicitors are already members of STEP (Society for Trust and Estate Practitioners) and are pleased that the Society is developing capacity assessment toolkits with guidance notes.

As part of our comprehensive service, we are pleased to offer a qualified understanding of issues surrounding capacity to make decisions and welcome all further guidance provided by STEP.
